Panda Bitchslap iPhone 4 & 4s Case

The idea for Panda Bitchslap came to me as I was doing a little research @ the Woodly Park Zoo in DC. As I walked to the panda section I saw swarms of tourists taking photographs with all sorts of flashes. I thought there must be something epic going on but it turned out that the panda was just snacking on some bamboo. I thought to myself, "Wow! It must really suck to be a panda and have all these people hassling me over a little bite to eat" That's when the Panda Bitchslap design hit me.

This iPhone case has been created to fit the iPhone 4 & 4S. It is made from a hard plastic that has been rubberized to prevent design chipping.?

Fiscal cliff deal would pale against expectations

WASHINGTON (AP) -- Whether negotiated in a rush before the new year or left for early January, the fiscal deal President Barack Obama and Congress cobble together will be far smaller than what they initially envisioned as an alternative to purposefully distasteful tax increases and spending cuts.

Instead, their compromise, if they do indeed cut a deal, will put off some big decisions about tax and entitlement changes and leave other deadlines in place that will likely lead to similar moments of brinkmanship, some in just a matter of weeks.

Republican and Democratic negotiators in the Senate were hoping for an accord as early as Sunday on what threshold to set for increased tax rates, whether to keep current inheritance tax rates and exemptions and how to pay for jobless benefits and avoid cuts in Medicare payments to doctors.

An agreement would halt automatic across-the-board tax increases for virtually every American and perhaps temporarily put off some steep spending cuts in defense and domestic programs.

Gone, however, is the talk of a grand bargain that would tackle broad spending and revenue demands and set the nation on a course to lower deficits. Obama and Republican House Speaker John Boehner were once a couple hundred billion dollars apart from a deal that would have reduced the deficit by more than $2 trillion over 10 years.

The trimmed ambitions of today are a far cry from the upbeat bipartisan rhetoric of just six weeks ago, when the leadership of Congress went to the White House to set the stage for negotiations to come.

"I outlined a framework that deals with reforming our tax code and reforming our spending," Boehner said as the leaders gathered on the White House driveway on Nov. 16.

"We understand that it has to be about cuts, it has to be about revenue, it has to be about growth, it has to be about the future," House Democratic leader Nancy Pelosi said at the time. "I feel confident that a solution may be in sight."

And Senate Majority Leader Harry Reid, D-Nev., offered a bold prediction: "There is no more let's do it some other time. We are going to do it now."

That big talk is gone for now.

Senate negotiators were haggling over what threshold of income to set as the demarcation between current tax rates and higher tax rates. They were negotiating over estate limits and tax levels, how to extend unemployment benefits, how to prevent cuts in Medicare payments to doctors and how to keep a minimum income tax payment designed for the rich from hitting about 28 million middle class taxpayers.

But the deal was not meant to settle other outstanding issues, including more than $1 trillion in cuts over 10 years, divided equally between the Pentagon and other government spending. The deal also would not address an extension of the nation's borrowing limit, which the government is on track to reach any day but which the Treasury can put off through accounting measures for about two months.

That means Obama and the Congress are already on a new collision path.

Republicans say they intend to use the debt ceiling as leverage to extract more spending cuts from the president. Obama has been adamant that unlike 2011, when the country came close to defaulting on its debts, he will not yield to those Republican demands.

As the day ended Saturday, there were few signs of success on a scaled-back deal, but no one was declaring a stalemate either.

Lawmakers have until the new Congress convenes to pass any compromise, and even the calendar mattered. Democrats said they had been told House Republicans might reject a deal until after Jan. 1, to avoid a vote to raise taxes before they had technically gone up, and then vote to cut taxes after they had risen.

Republicans said they were willing to bow to Obama's call for higher taxes on the wealthy as part of an agreement to prevent them from rising on those less well-off.

Democrats said Obama was sticking to his campaign call for tax increases above $250,000 in annual income, even though in recent negotiations he said he could accept $400,000. There was no evidence of agreement even at the higher level.

Obama, who once proposed nearly $1.6 trillion in tax revenue over 10 years, would get about half of that if he succeeded in getting a $250,000 threshold over 10 years. At a $400,000 level, the revenue figure drops to about $600 billion over a decade.

Republicans want to leave the estate tax at 35 percent after exempting the first $5 million in estate value. Officials said the White House wants a 45 percent tax after a $3.5 million exemption. Without any action by Congress, it would climb to a 55 percent tax after a $1 million exemption on Jan. 1. Obama's proposal would generate more than $100 billion in additional revenue over 10 years.

Democrats stressed their unwillingness to make concessions on both income taxes and the estate tax, and hoped Republicans would choose which mattered more to them.

Battling cancer, Chavez suffers more complications | FOX13Now ...

chavez

(CNN) ? Venezuelan President Hugo Chavez, who is recovering from cancer surgery, has suffered ?new complications,? Vice President Nicolas Maduro said Sunday.

?President Chavez?s state of health continues to be delicate, with complications that are being treated in a process that is not without risks,? he said.

Maduro spoke in Havana, Cuba, where Chavez is undergoing treatment. He said he met with Chavez, who has not been seen in public or heard from for weeks.

?Thanks to his physical and spiritual strength, Comandante Chavez is confronting this difficult situation,? Maduro said.

The Venezuelan president first announced he was battling cancer in June 2011.

Chavez, 58, has not disclosed what type of cancer he has, and the Venezuelan government has released few details about his illness, fueling widespread speculation about his health and political future.

Last year, Chavez had surgery to remove a cancerous tumor and has undergone further surgery and radiation in Cuba since. He returned to the island nation this month to undergo another surgery after publicly revealing that his cancer had returned.

He underwent a six-hour surgical procedure on December 11 that Maduro, in a televised address, declared a success.

A week after the president?s surgery, the Venezuelan information minster said Chavez was battling a respiratory infection. Minister Ernesto Villegas said then that the infection was under control.

Recently both Villegas and Maduro have struck a somber tone when discussing the president?s illness in contrast to previous government messages about his health. Villegas has suggested Chavez might not be not be back in Venezuela in time for his inauguration scheduled for next month.

Chavez addressed the delicate nature of his health before leaving Venezuela for Cuba. He said that if his health were to worsen, Maduro should replace him as president, making it the first time Chavez had spoken about a possible successor.

How Can You Sue The President??NPP Are Full Of Blockheads ? Gen. Mosquito

General Secretary of the National Democratic Congress (NDC), Johnson Asiedu Nketia, says he grossly erred in perceiving the New Patriotic Party (NPP) to be astute legal luminaries as he now considers them as a bunch of ?blockheads" masquerading as ?bookworms?.

To him, assertions by the NPP that over 1.3 million votes were stolen for John Mahama in the recent Presidential elections are laughable and misleading.

The NPP legal team officially filed a petition at the Supreme Court on Friday to challenge the 2012 presidential election results which declared the incumbent, Mr Mahama as the winner.

The opposition party claims it has uncovered that over 1.3 million votes were illegally counted and stolen for the NDC's John Mahama.

In the petition filed at the Supreme Court on Friday, the NPP prayed that the Supreme Court declares:

(1) That John Dramani Mahama, the 2nd Respondent herein was not validly elected president of the Republic of Ghana.

(2) That Nana Addo Dankwa Akufo-Addo, the 1st Petitioner herein, rather was validly elected President of the Republic of Ghana.

(3) Consequential orders as to this court may seem meet.

But the NDC Chief Scribe expressed disappointment at the news Conference the NPP held after filing the case in court.

Urging NDC faithfuls not to entertain any fears that the court could overturn the electoral results since the NPP has no evidence at hand, he slammed the NPP for whetting everybody's appetite with allegations of a rigging machinery, only for them to talk about an imperfect electoral system which is prevalent in any democracy.

Speaking to PeaceFM News in an interview, General Mosquito as the NDC General Secretary is affectionately called, said it beats his imagination that a party that prides itself of having the best legal brains could file a suit against the President of the republic.

?If they have suffered defeat, they should just accept it and figure out ways of ensuring that they can contest in the 2016 general elections. Their recent actions is disintegrating the NPP?We in the NDC are just waiting for the president to be sworn in because various accounts testify that we won hands done and nobody should be scared?.

?Suing the president exposes their blockheadedness and I wonder if they have ever heard that in this country before. That are just blowing hot air and if that move is deliberate, then it means that they are trying to fool their supporters. There is no way you can sue the president.

?What they are doing is just like a coward who is trying to commit suicide and at the same time telling his family members that 'this is the spot where I am going to commit the act so come and rescue me'. If they are heading to the Supreme Court, then it was needless for them to have organized a press conference?, he said.

Camila Alves & Matthew McConaughey Welcome A Baby Boy!

Christmas was extended for?Camila Alves and Matthew McConaughey who welcomed their third child, a boy on Friday. That is right the?McConaughey’s ended 2012 with a brand new addition to their family. People magazine broke the story that Matthew and his wife of less than a year have become parents for the third time. Their son was born yesterday morning in Austin Texas. Details of the new bundle of joy’s arrival had been kept private until now, including the name which was just revealed by the actor in the below Tweet. “Camila gave birth to our third child yesterday morning. Our son, Livingston Alves McConaughey, was born at 7:43 a.m. on 12.28.12.?”He greeted the world at 9 lbs., and 21 inches. Bless up and thank you for your well wishes.” The actor who is pretty good about keeping his private life private kept the details of their son’s birth quiet for a whole day. I guess they were looking for some private time with their new little one. I am sure at some point a reputable magazine will showcase the family with their baby boy who joins big brother Levi, age 4 and big sister Vida, age 2. There were reports [...]

Mystery BlackBerry 10 device hits the FCC with AT&T-capable LTE

Mystery BlackBerry 10 device hits the FCC with AT&Tcapable LTE

RIM's January unveiling isn't going anywhere without federal approval, and it seems the FCC is happy to oblige. Regulators put an unnamed BlackBerry device with a RFF91LW model number through the standard tests, giving it the green light for AT&T's LTE and GSM bands, as well as a few international frequencies. The handset's label sample is conveniently censored, of course, but FCC reports indicate that at least three of the devices RIM provided were running OS 10.0.9. Could we be seeing the "L-series" BlackBerry Z10? Or is this simply one of the Dev Alpha devices RIM has been handing out to developers? Either way, we'll get verification next month.

Hands-on with Jolla's Sailfish OS (video)

Handson with Jolla's Sailfish OS video

We recently had the chance to spend time with David Greaves and Vesa-Matti Hartikainen of Jolla and take Sailfish OS for a spin. As you might recall, this open source mobile OS builds upon Mer (a fork of MeeGo that includes Qt) and uses the Nemo framework with a custom UI. Like any decent Linux-based OS, it supports both ARM and x86 devices. The company is also behind the Sailfish SDK which is in the process of being finalized but is still open to developer feedback (the source code is available). After seeing Jolla's various demo videos and noting some UI similarities with MeeGo (swipes) and strangely, with BB10 (peek gestures) we were eager to experience Sailfish OS for ourselves. If you're wondering why the mobile OS is usually shown running on Nokia's N950 developer handset, that's because Jolla employs many ex-MeeGo engineers, so the OMAP-based phone was a natural fit. We were first given a walkthrough of Sailfish OS, then allowed to play with it. Many apps are still being worked on (and some are still off-limits: we got in trouble for launching the camera), but what we saw was pretty solid. Take a look at the gallery below, then hit the break for our hands-on video and first impressions.

Whether it is for augmentation, liposuction, or a lift, women often go into plastic surgery without being aware of all the aspects. This book, written by a female plastic surgeon, gives an objective, knowledgeable overview of the different procedures and includes topics such as decision making, smart questions to ask, expectations, possible complications, and recovery.

Surgery Junkies: Wellness and Pathology in Cosmetic CultureSurgery Junkies: Wellness and Pathology in Cosmetic CultureThe ease of accessibility, improvements in safety and technology, media attention, growing acceptance by the public, or an increasingly superficial culture: whatever the reason, cosmetic surgery is more popular today than ever. In 2005, in the United States alone, there were nearly two million aesthetic operations-more than quadruple the number from 1984, along with more than eight million non-surgical procedures. Innovative surgical methods have also brought cosmetic improvements to new areas of the body, such as the ribs, buttocks, and genitalia.

Despite the increasing normalization of cosmetic surgery, however, there are still those who identify individuals who opt for bodily modifications as dupes of beauty culture, as being in conflict with feminist ideals, or as having some form of psychological weakness. In this ground-breaking book, Victoria Pitts-Taylor examines why we consider some cosmetic surgeries to be acceptable or even beneficial and others to be unacceptable and possibly harmful. Similarly, why are some patients considered to be psychologically healthy while others deemed pathological? When is the modification of our appearance empowering and when is it a sign of weakness?

Drawing on years of research, her personal experience with cosmetic surgery, analysis of newspaper articles and television shows, and in-depth interviews with surgeons, psychiatrists, lawyers, judges, and others, Pitts-Taylor brings new perspectives to the promotion of "extreme" makeovers on television, the medicalization of "surgery addiction," the moral and political interrogation that many patients face, and feminist debates on the topic.

While many feel that cosmetic surgery is a deeply personal choice and that its pathology is rooted in the individual psyche, Pitts-Taylor makes a compelling argument that the experience, meanings, and motivations for cosmetic surgery are highly social. A much needed "makeover" of our cultural understanding of cosmetic surgery, this book is both authoritative and thoroughly engaging.

PFT: Andy Reid wants to coach in 2013

Mario WilliamsAP

Patriots TE Rob Gronkowski (forearm) has increased his practice reps to a normal level.

Dolphins LB Karlos Dansby has never made it to the Pro Bowl, and he says he doesn?t care; ?I?m about breaking records and reaching milestones. I?m about being a legend,? Dansby said.

Bills DE Mario Williams doesn?t think this season was a failure.? (We?d hate to see how bad the Bills would have been if it were.)

The Jets say DT Muhammad Wilkerson has a concussion; he says he doesn?t.

For Browns S Tashaun Gipson, any game that presents an opportunity to ?put[] out some good tape? isn?t a meaningless game.

An email from a fan has inspired the Ravens.

Bengals LB Vontaze Burfict hated being away from home for Christmas, though he understands he has a job to do; ?The worst part of it was when I called home and my mom said, ?The family?s all here and we?re eating gumbo,? ? Burfict said. ?Man, I wished I was there.? But I?ve got duties to take care of.? Family is always going to be there.?

Steelers TE Heath Miller ended the season with both a serious knee injury and the team?s MVP award.

Titans defensive coordinator Jerry Gray doesn?t think his unit quit during a 55-7 loss to the Packers.? (We?d hate to see how bad the score would have been if they had.)

Jaguars defensive line coach Joe Cullen turned down an offer to become the defensive coordinator at Boston College.? (Apparently, there isn?t a Wendy?s on campus.)

Here?s a look at the Colts? seven comeback wins in 2012.

With two sacks needed to tie Michael Strahan?s record, Texans DE J.J. Watt surely wishes he was facing Brett Favre this weekend.

Chargers S Eric Weddle didn?t make it to the Pro Bowl, but he has been named the team?s MVP.

Defensive back Brandian Ross is one of the most versatile players on the Raiders? roster.

Four teams in NFL history have won 10 or more games in a row by seven or more points each, and Broncos quarterback Peyton Manning has been on two of them.

Despite rumors linking Tony Dungy to the Chiefs, Dungy say he won?t be coaching ?there or anywhere else.?

Giants WR Victor Cruz says repeating as Super Bowl champions is tougher than it looks.

An absence of impact players drafted in rounds one or two could be the biggest factor in the demise of Eagles coach Andy Reid.

Cowboys RB DeMarco Murray isn?t thinking about his fumbles; ?Doesn?t bother me at all,? Murray said. ?Last week was last week. Two weeks was two weeks ago. I don?t worry about mistakes. . . .? I have a short term memory, good, bad, negative, positive, I just move on.?

Six straight wins and the cusp of a division title is earning praise for Redskins coach Mike Shanahan.

Lions defensive coordinator Gunther Cunningham says his biggest disappointment this season is the failure of the team to generate turnovers.

Vikings DE Brian Robison realizes the difficulty of rushing the passer with a bad shoulder; ?Every freaking movement is with your shoulder,? he said.

Now that the Bears? defense has found the end zone again, they hope to visit again on Sunday.

Whether Packers WR Randall Cobb plays and what he does if he plays will be determined on Sunday.

Panthers WR Brandon LaFell may be on track to becoming the team?s new Steve Smith.

Falcons WR Roddy White is finally getting noticed for his ability to play through injury.

Buccaneers QB Josh Freeman says that the team?s offense has been trying to do too much.

Saints offensive coordinator Pete Carmichael, Jr. isn?t thinking about the possibility of being pursued elsewhere.

The Seahawks last failed to score in the red zone in Week Nine, when they took a knee at the nine to end a win over the Vikings.

The Rams? three leading receivers are within two yards of each other.

A doctor who hasn?t examined or treated 49ers DL Justin Smith believes he will need 12 weeks to recover from his torn triceps.

Cardinals P Dave Zastudil is trying to hang on to the single-season record for punts downed inside the 20.

NHL makes new offer to players

NEW YORK (AP) ? The NHL says it has made a new contract offer to the players in an attempt to end the lockout and save the season.

Deputy commissioner Bill Daly says in a statement Friday that a "comprehensive" proposal was made a day earlier, although he would not discuss details.

He adds that the league is "hopeful" that once the union and its negotiating committee review the proposal "they will share it with the players. We want to be back on the ice as soon as possible."

The lockout is in its 104th day. The NHL says it doesn't want a season of less than 48 games. To make that possible, a deal likely must be reached by mid-January. The sides haven't met face to face since talks with a federal mediator broke down Dec. 13.

Dear 2013: A Word About My Marketing. . . - Small Business ...

Dear 2013,

2012 was just fine, but I really need 2013 to be better than just fine. So here?s what you can expect from me, in no particular order:

I?m going to be in a hurry. So it needs to be okay that we fail, and fail often. But no worries, we?ll fail small, and each time we?ll pick ourselves up, take a look at what worked and what didn?t, make adjustments and keep going.

So just relax 2013, and know that I?ll never bet the farm and with each step we take we?ll be one step closer to making 2013 the best year ever.

I?m going to be trying new things. ?Calm down, just because something?s new doesn?t mean it?s risky or coming from ?left-field?. It just means we haven?t tried it before. So take a chill pill 2013!!

I?m going to be doing a lot of thinking this year, too. I know, I know. That may be a bit scary for you (it is for me!). I?m going to be paying attention to what a lot of other companies are doing. Companies that have no obvious connection with what we do. But I?m going to do it to learn, because even though we?re not Apple or Google or Amazon or that innovative manufacturer in Indiana, I can learn something from what they do and how they think. So 2013, if I choose to read each morning before I look at my email, or take a walk at lunch, don?t worry, I won?t have lost my mind, I?ll simply be using it more than usual.

And finally 2013, I?m strangely comfortable not needing to know exactly what will happen in month nine or month 11 of a business plan. I?m okay putting one foot in front of the next with the confidence I?ll know what adjustments to make to continue down the path to success ? I?ll know what feels right and what feels wrong. You?re right, this is different than the 2012 me. But understand, I feel really great about 2013 because the Mayans, in all their amazing wisdom and ability to build fantastic civilizations in the jungle, were wrong. So I sort of feel like 2013 is a gift, and I?m going to take full advantage. ?Or, maybe it?s because I?ve competed in this increasingly digital world long enough to know as fast as things change, a one-foot-in-front-of-the-next strategy makes sense. ?Thinking I can control things 12 months out, does not.

Come on along, it?s going to be a great ride! ?Here. ?We. ?Go!

The One-Eyed Man Is King

Man in a tux wearing a monocle. A man of the highest social echelon, as evidenced by his choice of eyewear

Studio-Annika/iStockphoto.

Eustice Tilley, the dandyish mascot of The New Yorker, telegraphs his estimable class status with a number of chic-yet-dignified sartorial choices, a top hat and topcoat among them. But the accessory that most efficiently communicates Mr. Tilley?s caste is his monocle: a single, bespoke lens secured round his neck by a fine string and held aloft before his discerning eye. By the time Tilley graced The New Yorker?s inaugural cover in 1925, the image of the bemonocled man-about-town had already become a thing of caricature. How did the monocle become a symbol of wealth?

It was a symbol of wealth from the start. The standard monocle is essentially a small magnifying glass without a handle (though early versions generally had one). The monocle can be helpful in reading small print and before the advent of modern refractive-error testing it was thought to be capable of correcting myopia, but sporting one as a general part of one?s attire was always something of a fashionable affectation. Like the lorgnette, spyglass, and, a direct ancestor, the quizzing glass, the monocle basically originated as a faddish accessory of those with the cash and the inclination to purchase such things. It was most popular with the moneyed classes in Europe in the 1820s and ?30s, and experienced a revival in the 1890s.

Though the exact origins of the monocle are unclear, fashion historian Richard Corson sets their general appearance around the turn of the 19th century in Great Britain, with quick adoption and further development in Germany. According to a 1950 article from Optical Journal, from the beginning the single lens carried with it ?an air of conscious elegance,? making it ripe for ridicule: ?[O]ne had the feeling the wearer was being a trifle foolish, an attitude which resulted to some extent from the fact that monocles frequently did not fit and kept dropping out of place.?

Indeed, the impractical design of monocles ensured their status as a luxurious object. In order to avoid muscle strain, the frame of the monocle?which may be made of gold, silver, tortoise shell, and other materials?must be custom-fitted to the wearer?s eye, an expensive proposition. Additional support may come from a ?gallery,? a raised edge that helps keep the lens away from the wearer?s eyelashes and more firmly ensconced in the eye orbit. Due to their sensitivity to gravity, monocles are almost always attached to a chain or string.

The association of monocles with a stereotype of the rich, especially with the rich and pretentious, began at least as early as Charles Dickens? skewering of young Mr. Barnacle?s intractable eyepiece in Little Dorrit, serialized between 1855 and 1857. In America, the image was largely popularized by E.A. Sothern?s portrayal of the silly English nobleman Lord Dundreary in Our American Cousin, first performed in 1858.

Still, there?s traditionally been at least some demand for the eyepiece among the less-moneyed. Mass-produced monocles of inferior quality were available throughout the 1800s and worn by men?and occasionally women?of more modest means. Currently, a monocle in ?whisky tortoise? can be had from the eye-dresser Warby Parker for $50.

Stocks log 3-day decline on 'cliff' fears

7 hrs.

Stocks eased off their lows but still finished in the red Wednesday, extending losses for a third-straight session, as weakness in the retail sector and ongoing worries over the looming "fiscal cliff" put a damper on gains.

"There's just no certainty and people don't know where to step," said Stephen Guilfoyle of Meridian Equity Partners. "We're kind of in a quandary here?the market didn't catch at 1,422 like it was supposed to and the next catch point is 1,415 on the S&P. There's not a lot of volume and you have a lot of traders with question marks on their heads right now."?

The Dow Jones Industrial Average?ended in negative territory for the third?straight session, dragged by UnitedHealth. Bank of America led the blue-chip gainers.

The S&P 500 and the Nasdaq also closed lower. The CBOE Volatility Index (VIX), widely considered the best gauge of fear in the market, gained above 19.

Most key S&P sectors finished in negative territory, led by consumer discretionary, while materials?gained.?

Obama will return to Washington early on Thursday, according to the White House, to deal with the deadlocked talks between Democrats and Republicans on what to do with $600 billion in tax increases and automatic spending cuts, due to kick in on Jan. 1.

"I don't think the President is coming back from Hawaii without anticipating we're getting something done so I'm optimistic and the street is somewhat optimistic too," said Gordon Charlop of Rosenblatt Securities. "You don't get a sense that they're selling into the pessimism that people are trying to circulate about the fiscal cliff not being resolved."?

(Read More:Over the Fiscal Cliff: What Kind of Landing?)

Wall Street has been increasingly worried that the two sides may not reach a deal in time. Art Cashin, director of floor operations for UBS, said such an outcome would result in a 95 percent chance of a U.S. recession next year.

"We'll be looking at muted volume," Charlop added. "It's going to be a wait-and-see session."

Volume is expected to remain throughout the shortened-holiday trading week with many traders still on vacation and with major European markets closed for the day for Boxing Day. In Asia, markets closed higher on thin volumes, with Japanese stocks rallying to hit nine-month highs on a weaker yen.

Worries over the fiscal cliff and an extremely weak report on the holiday shopping season put major retail stocks including Macy's, Wal-Mart and Target under pressure. Coach, Urban Outfitters and Ralph Lauren were also sharply lower.

Sales in the two months before Christmas rose just 0.7 compared to last year, the slowest rate of growth since 2008, according to the MasterCard Advisors Spending Pulse. Analysts had been expecting growth of 3 to 4 percent.

Amazon.com and Netflix were both slightly lower after an outage at an Amazon web service center impacted Netflix subscribers in the U.S., Canada, and Latin America on Christmas eve. Service was fully restored by Christmas day.

Meanwhile, Apple?weighed on the tech sector and the Nasdaq 100 index, slipping nearly 1 percent.

Research In Motion soared to lead the Nasdaq 100 gainers as pictures of what is believed to be the newest BlackBerry device with a physical keyboard made rounds on the Internet. The BlackBerry 10 launch event is expected to take place on January 30.

Marvell Technology plunged more than 10 percent after a federal jury ordered the semiconductor company to pay $1.2 billion in damages in a patent infringement lawsuit against Carnegie Mellon University.?

Herbalife rallied, looking to snap a nine-day losing streak, after the nutrition and skin-care products company retained a legal firm to help defend itself against attacks by hedge fund manager Bill Ackman, according to the Wall Street Journal. Last week, Ackman shorted?Herbalife's stock and accused the company of operating a pyramid scheme.

On the economic front, the S&P/Case Shiller home price index of 20 major cities rose 0.7 percent in October on a seasonally adjusted basis, topping expectations for a gain of 0.5 percent. And prices in the 20 cities jumped 4.3 percent from last year, beating forecasts for an increase of 4.0 percent.

Meanwhile, the Federal Reserve Bank of Richmond said manufacturers in the central Atlantic region posted modest activity in December, but at a slower pace than in November.?

(AP) ? Former Atlanta Braves star center fielder Andruw Jones was free on bond after being arrested in suburban Atlanta early Tuesday on a battery charge, according to jail records.

Around 1:30 a.m. Tuesday, police responded to a call for a domestic dispute between Jones and his wife in Duluth.

Officials: NY gunman led quiet life before killing 2 firefighters

WEBSTER, N.Y. - A man who set his house on fire then lured firefighters to their deaths in a blaze of flames and bullets had attracted little attention since he got out of prison in the 1990s for killing his grandmother, authorities said.

But two months ago, William Spengler's mother died, leaving the 62-year-old ex-con in a Lake Ontario house with his sister, who he "couldn't stand," a friend said.

Spengler set a car and a house in his neighbourhood ablaze early Monday, luring firefighters to the neighbourhood and then killed two, wounded two others and injured a police officer while several homes burned around him, police said. Spengler then killed himself. His sister, Cheryl, was missing.

About 100 people attended an impromptu memorial vigil Monday evening in Webster, a suburb of Rochester. Dozens of bouquets were left at the fire station, along with a handwritten sign that said, "Thanks for protecting us. RIP."

Spengler, had been living in the home in Webster, a suburb of Rochester, with his mother and sister since his parole in 1998. He had served 17 years in prison after the beating death of his 92-year-old grandmother in 1980, for which he had originally been charged with murder but pleaded guilty to a reduced charge of manslaughter. His mother, Arline, died in October.

On Monday, Spengler fired at the four firefighters when they arrived shortly after 5:30 a.m. at the blaze, town police Chief Gerald Pickering said. The first police officer who arrived chased the gunman and exchanged shots.

Spengler lay in wait outdoors for the firefighters' arrival, then opened fire probably with a rifle and from atop an earthen berm, Pickering said. "It does appear it was a trap," he said.

Authorities used an armoured vehicle to help residents flee dozens of homes on the shore of Lake Ontario a day before Christmas. Police restricted access to the neighbourhood, and officials said it was unclear whether there were other bodies in the seven houses left to burn.

Authorities said Spengler hadn't done anything to bring himself to their attention since his parole. As a convicted felon, he wasn't allowed to possess weapons. Monroe County District Attorney Sandra Doorley said Spengler led a very quiet life after he got out of prison.

A friend said Spengler hated his sister. Roger Vercruysse lived next door to Spengler and recalled a man who doted on his mother, whose obituary suggested contributions to the West Webster Fire Department.

"He loved his mama to death," said Vercruysse, who last saw his friend about six months ago.

Vercruysse also said Spengler "couldn't stand his sister" and "stayed on one side of the house and she stayed on the other."

The West Webster Fire District learned of the fire early Monday after a report of a car and house on fire on Lake Road, on a narrow peninsula where Irondequoit Bay meets Lake Ontario, Monroe County Sheriff Patrick O'Flynn said.

The fire appeared from a distance as a pulsating ball of flame glowing against the early morning sky, flames licking into treetops and reflecting on the water, with huge bursts of smoke billowing away in a brisk wind.

Emergency radio communications capture someone saying he "could see the muzzle flash coming at me" as Spengler carried out his ambush. The audio posted on the website RadioReference.com has someone reporting "firefighters are down" and saying "got to be rifle or shotgun - high powered ... semi or fully auto."

Two of the firefighters arrived on a fire engine and two in their own vehicles, Pickering said. After Spengler fired, one of the wounded men fled, but the other three couldn't because of flying gunfire.

The police officer who exchanged gunfire with Spengler "in all likelihood saved many lives," Pickering said.

A police armoured vehicle was used to recover two men, and eventually it removed 33 people from nearby homes, the police chief said. The gunfire initially kept firefighters from battling the blazes.

The dead men were identified as police Lt. Michael Chiapperini, 43, the Webster Police Department's public information officer; and 19-year-old Tomasz Kaczowka, also a 911 dispatcher.

Pickering described Chiapperini as a "lifetime firefighter" with nearly 20 years in the department, and he called Kaczowka a "tremendous young man."

Kaczowka's brother, reached at the family home Monday night, said he didn't want to talk.

The two wounded firefighters, Joseph Hofstetter and Theodore Scardino, remained in guarded condition Tuesday at Strong Memorial Hospital, authorities said. Both were awake and alert and are expected to recover.

Hofstetter, also a full-timer with the Rochester Fire Department, was hit once in the pelvis, and the bullet lodged in his spine, authorities said. Scardino was hit in the chest and knee.

At West Webster Fire Station 1, there were at least 20 bouquets on a bench in front and a bouquet of roses with three gold-and-white ribbons saying, "May they rest in peace," ''In the line of duty" and "In memory of our fallen brothers."

A handwritten sign says, "Thanks for protecting us, RIP." Two candles were lit to honour the dead.

Grieving firefighters declined to talk to reporters. At an impromptu memorial vigil Monday evening, about 100 people stood in the cold night air, some holding candles. A fire department spokesman made a brief appearance, thanked them all and told them to go home and appreciate their families.

Cathy Bartlett was there with her teenage son, who was good friends with Kaczowka. Bartlett's husband, Mark Bartlett, has been a firefighter there for 25 years but missed the call this morning.

"Thank God my husband slept through the first alarm and didn't get up until the second one went off," she said.

The shooting and fires were in a neighbourhood of seasonal and year-round homes set close together across the road from the lakeshore. The area is popular with recreational boaters but is normally quiet this time of year.

"We have very few calls for service in that location," Pickering said. "Webster is a tremendous community. We are a safe community, and to have a tragedy befall us like this is just horrendous."

O'Flynn lamented the violence, which comes on the heels of other shootings including the massacre of 20 students and six adults at Sandy Hook Elementary School in Newtown, Conn.

"It's sad to see that this is becoming more commonplace in communities across the nation," O'Flynn said.

Gov. Andrew Cuomo said the State Police and Office of Emergency Management were working with local authorities.

"Volunteer firefighters and police officers were injured and two were taken from us as they once again answered the call of duty," Cuomo said in a statement. "We as the community of New York mourn their loss as now two more families must spend the holidays without their loved ones."

Webster, a middle-class suburb, now is the scene of violence linked to house fires for two Decembers in a row.

Last Dec. 7, authorities say, a 15-year-old boy doused his home with gasoline and set it ablaze, killing his father and two brothers, 16 and 12. His mother and 13-year-old sister escaped with injuries. He is being prosecuted as an adult.

Hitachi CEO: Still in talks on Lithuania nuclear project

TOKYO (Reuters) - Japan's Hitachi Ltd remains in talks with Lithuania over its plans to build a nuclear plant after the European country's new centre-left government said it could shelve nuclear projects, the company's top executive said on Tuesday.

Hitachi, a century-old conglomerate that designs and builds nuclear power plants with General Electric Co in two joint ventures, has shifted its focus overseas as Japan shuns nuclear energy in the wake of the worst radiation crisis in 25 years at the Fukushima Daiichi nuclear plant last year.

Hitachi's nuclear joint venture had been lined up to supply a nuclear energy plant to Lithuania under the country's previous government, which lost power in October.

"There might be a slight lag in the time period, but the talks have not been completely suspended," Hiroaki Nakanishi, Chief Executive of Hitachi, said at a press briefing.

Nakanishi said he did not think the worldwide market for nuclear energy would shrink, but said it was impossible to form a sales outlook for Hitachi's nuclear business before Japan's own energy policy has been concluded.

The company has previously said it aimed to reach 360 billion yen ($4.25 billion) in sales in the nuclear business by fiscal year 2020. Hitachi's power systems division, which includes its thermal and nuclear power business, logged 832.4 billion yen in sales the year ended March.

The December election victory of Japan's Liberal Democratic Party, headed by incoming prime minister Shinzo Abe, has fuelled speculation that the new government would take a friendlier stance toward nuclear power.

Nakanishi is credited with a sweeping cost-cutting initiative at Hitachi. The firm is consolidating its 900-plus subsidiaries as it tries to take on global rivals like GE and Siemens AG .

The company most recently merged its thermal power division with that of Mitsubishi Heavy Industries Ltd and executives from both firms have said they are open to working together on nuclear power.

Hitachi and Mitsubishi Heavy compete against Toshiba Corp in thermal power projects in Japan. The three companies are also rivals in nuclear power projects overseas. Most recently, Hitachi beat Toshiba and its subsidiary Westinghouse to a $1.1 billion deal in October to build six nuclear plants in Britain.

In a further sign of consolidation, company subsidiaries Hitachi Metals Ltd and Hitachi Cable Ltd have said they will merge their businesses next April. Nakanishi said on Tuesday Hitachi Transport System Ltd and Hitachi Capital Corp should remain listed separately.

Shares in Hitachi ended up 0.4 percent at 484 yen on Tuesday, against a 1.4 percent rise on Tokyo's benchmark Nikkei average <.n225>. ($1 = 84.7950 Japanese yen)

How Intimate Relationships Fail | Psychology Today

There are three clear cut ways to measure if your relationship is thriving or headed for trouble. Independently or simultaneously, they pose significant threats to a relationship?s survival. The sooner intimate partners recognize them and change their patterns, the more likely they can get their relationship back on track and recreate the love they once knew. ?

Threat Number One ? When bad interactions begin to outnumber good ones

Most intimate love relationships begin with many more positive, intriguing, and loving interactions than painful ones. In time, though, every relationship will face unexpected hurdles that create negative interactions. If the partners do not resolve the resulting emotional damage at the time, they will silently suffer from those buried, unresolved issues and begin the process of withdrawing energy and hope from the relationship. ?

When your relationship began, you most likely remember how treasured you felt by your partner, praised for your assets and readily forgiven for your faults. Some ?not-so-compatible? areas may have existed, but consciously or unconsciously, you chose to give them less attention. ?

Over time, those non-attended-to negative interactions may have changed the percentages of good connections to bad ones. Now you are having more difficulty both erasing them and also holding on to the positives you once took for granted. The good parts of your relationship may still be there, but the damage is taking its toll and you can feel each other?s lowered frustration tolerance and increased quickness to anger. Emotional scars are building and your relationship?s ability to create new options is diminishing.

If you cannot transform your negative patterns and grow beyond your current limitations, your lack of action will keep feeding energy into the bad interactions and starve out the good ones. Your relationship will begin to show signs of decay: loss of hope, more conflict, and decreased intimacy. Stuck in old patterns and destructive rituals, you may no longer be able to access the resilience you once had.

Solution

The imbalance of bad interactions to good can be reversed if both partners do the following:

  1. Recognize the direction the relationship is going without blaming each other for what has happened. This is a crucial time to not judge, but simply to share your observations with each other without becoming defensive.
  2. Identify and stop whatever interactions that may be causing either of you to feel scarred. You must stop your destructive behaviors destruction before you can move forward.
  3. Begin focusing on behaviors that still feel positive between you, and share those observations. Agree to continue to remind each other of feel-good interactions every day until your love feels stronger again.
  4. Look for new ways to go beyond your current relationship?s limitations by creating better communication skills, more joyful times together, re-prioritizing your obligations and commitments, and cutting down on any stressors that have weighed your both down.

Threat Number Two ? Letting attachments suppress authenticity

Every partner in an intimate relationship has attachments to his or her significant other. An attachment is anything that you may be afraid to lose or something you want from your partner. As the relationship matured, you may both have increased or added attachments to certain behaviors, and found others to be less important. ?

As you deepened your commitment to each other, your attachments likely increased as well. To keep them secure, you had to sacrifice some of your own needs at times in order to give your partner what he or she wanted from you. You may have felt a little martyred some of the time, or even gave up some of your own self-respect, but in the moment, it seemed the right thing to do. You felt that your partner not only recognized your willing sacrifice, but would readily have done the same for you.

Somehow, over time, you began to feel that you were giving more than you were getting back. Your sacrifices now appear to be more expected and your paybacks are not adequately compensating you for your efforts. Your partner not only doesn?t give you more of what you want, he or she doesn?t even recognize that you?ve been silently bargaining.

If you allow this imbalance to continue, you will eventually feel like you?re being taken for granted and lose trust in your partner?s willingness to reciprocate. Shutting down your own needs to keep your attachments from being threatened, you are now self-blackmailing just to keep things in place. Worse, you may be blaming your partner for breaking a contract that he or she never signed.

Status quo attachments are hard to give up. You started out readily sacrificing and expecting reciprocity, as your partner may have as well. Over time, you may have also have created many other legitimate tethers: children, possessions, families, friends, business partnerships, spiritual communities, values, and commitments. You would understandably want to hold on to those attachments, not knowing how to resolve with the imbalance that is now expected.

Solution

  1. Make a list of the behaviors or things you are attached to in your relationship. Put a number from one to ten after each to let your partner know how important they are to you. Asking yourself what you would be afraid to lose can help guide you in creating your list.
  2. Tell your partner which of the things on the list he or she already provides for you, and which you feel you are not getting.
  3. Let your partner know those things or behaviors you have been willingly sacrificing, and those you martyred yourself in giving.
  4. Ask your partner if there is anything you can do to get your needs met.
  5. Ask your partner which things you are presently sacrificing that may no longer be important to him or her.

Threat Number Three ? Trust-breaking incidents

Most new couples do not address their non-negotiable bottom lines up front. They either trust that their lovers have the same values and ethics, or believe that they would never hurt them by doing something they have agreed would be unacceptable.

You probably began the same way. Then, as your relationship matured, you discovered new things about each other that altered your initial perceptions. Some of those revelations were delightful surprises that deepened your trust and love. Others may have caused concern, like past behaviors that your current relationship could not survive. You?ve probably talked to each other about what each of you holds sacred, and trusted that your commitment would keep any potential trust-breaking at bay.

As you grew to know what your partner could or could not tolerate, you may have begun withholding some potentially relationship-destroying thoughts, telling yourself that you would never act upon them. Perhaps you feared a loss of your intimacy or painful criticism if you did share what you were thinking. Whatever the apprehension, you chose to keep them in an internal, emotionally secret compartment to keep the love between you intact. ?

If you were aware of the slippery slope you were creating by rationalizing the situation, you may have decided to risk sharing your internal desires with your partner to restore your relationship?s authenticity. Hopefully, your partner was grateful that you were honest and was willing to work with you. If, instead, he or she communicated anger, resentment, or fear, you may have regretted your decision to be honest, offered superficial reassurance to ameliorate the situation, and gone underground again. That choice will have left you vulnerable to act out your hidden desires at some future time.

Couples who cannot share their secret thoughts or behaviors risk the loss of their intimacy. Their bond weakens, and they are more likely to act without considering the outcome. For instance, one partner may have started a non-flirtatious relationship with a co-worker, then found it slowly becoming more intimate over time. Were the other partner to know, he or she would feel exposed, threatened, or embarrassed. The initially innocent partner now cannot share how far it has gone without fearing incrimination or loss.

If you have been the unfortunate one who discovers your partner?s secret, threatening behavior, your trust may be irrevocably shattered. You must now decide whether you to stay in the relationship, and, if so, what it would take to rebuild. A significant break in trust is agonizingly difficult to repair, and you both must decide if you have what it takes to stay together.

Mount Sinai survey shows that nearly 1 in 3 children with food allergies experience bullying [ Back to EurekAlert! ] Public release date: 24-Dec-2012

The Mount Sinai Hospital / Mount Sinai School of Medicine

Nearly a third of children diagnosed with food allergies who participated in a recent study are bullied, according to researchers at the Icahn School of Medicine at Mount Sinai. Almost eight percent of children in the U.S. are allergic to foods such as peanuts, tree-nuts, milk, eggs, and shellfish.

Nearly half of parents surveyed (47.9 percent) were not aware of the bullyingalthough both the bullied children and their parents reported experiencing higher stress levels and lower quality of life.

The study, titled, "Child and Parental Reports of Bullying in a Consecutive Sample of Children with Food Allergy," appears in the online issue of Pediatrics on December 24. The study was led by Eyal Shemesh, MD, Associate Professor of Pediatrics and Psychiatry at the Icahn School of Medicine at Mount Sinai. Dr. Shemesh and his team surveyed 251 pairs of parents and children. The patient and parent pairs were consecutively recruited during allergy clinic visits to independently answer questionnaires. Bullying due to food allergy or for any cause, quality of life, and distress in both the child and parent were evaluated using validated questionnaires.

"Parents and pediatricians should routinely ask children with food allergy about bullying," said Dr. Shemesh. "Finding out about the child's experience might allow targeted interventions, and would be expected to reduce additional stress and improve quality of life for these children trying to manage their food allergies." Dr. Shemesh is Director of EMPOWER (Enhancing, Managing, and Promoting Well-being and Resiliency), a program within Mount Sinai's Jaffe Food Allergy Institute. Dr. Shemesh is also Chief of the Division of Behavioral and Developmental Health in the Department of Pediatrics at The Mount Sinai Medical Center.

"When parents are aware of the bullying, the child's quality of life is better," said the senior author, Scott H. Sicherer, MD, Professor of Pediatrics, Chief, Division of Pediatric Allergy, Co-Director, EMPOWER program. "Our results should raise awareness for parents, school personnel, and physicians to proactively identify and address bullying in this population."

The work for the study was supported by the EMPOWER program, a program funded by a generous donation from the Jaffe Family Foundation, that is devoted to understanding and enhancing the quality of life of persons with food allergy.
