Apple's China legal battle over iPad spreads to U.S. | China Media

A Chinese firm trying to stop Apple Inc from using the iPad name in China has launched an attack on the consumer electronics giant?s home turf, filing a lawsuit in California that accuses it of employing deception when it bought the trademark.

A unit of Proview International Holdings Ltd, a major computer monitor maker that fell on hard times during the global financial crisis, is already suing Apple in multiple Chinese jurisdictions and requesting that sales of iPads be suspended across the country.

Last week, Proview Electronics Co Ltd and Proview Technology Co filed a lawsuit in Santa Clara County that brings their legal dispute to Silicon Valley.

Some legal experts said there could be different outcomes from the U.S. and Chinese cases, but a spreading of the lawsuit and delay in coming to settlement terms could hurt Apple more.

?In relation to the U.S., Apple is going to somewhat have a homeground advantage,? said Elliot Papageorgiou, a Shanghai-based partner and executive at law firm Rouse Legal (China).

At stake for Apple is its sales and shipments in China, where its CEO Tim Cook said it was merely scratching the surface. Debt-laden Proview International, meanwhile, needs to come up with a viable rescue plan before mid-2012 or else it faces delisting from the Hong Kong stock exchange.

?Given the current timeline, Apple would have the greater impetus to come to settlement simply because the ability to disrupt shipments is more immediate than the pressure faced by Proview and its potential delisting,? said Papageorgiou.

Proview accuses Apple of creating a special purpose entity ? IP Application Development Ltd, or IPAD ? to buy the iPad name from it, concealing Apple?s role in the matter.

In its filing, Proview alleged lawyers for IPAD repeatedly said it would not be competing with the Chinese firm, and refused to say why they needed the trademark.

Those representations were made ?with the intent to defraud and induce the plaintiffs to enter into the agreement,? Proview said in the filing dated February 17, requesting an unspecified amount of damages.

Apple on Friday reiterated its statement saying that it had bought Proview?s worldwide rights to the iPad trademark in 10 different countries several years ago. It also said that Proview had refused to honor their agreement and a Hong Kong court had sided with the U.S. technology giant in the matter.

?Our case is still pending in mainland China,? Apple said.

DISPUTE HINGES ON 2009 DEAL

The battle between a little-known Asian company and the world?s most valuable technology corporation dates back to a disagreement over precisely what was covered in a deal for the transfer of the iPad trademark to Apple in 2009.

Authorities in several Chinese cities, such as Shijiazhuang and Huizhou, have already banned the sale of iPads, citing the legal dispute.

Proview, which maintains it holds the iPad trademark in China, has been suing Apple in various jurisdictions in the country for trademark infringement, while also using the courts to get retailers in some smaller cities to stop selling the tablet PCs.

Major electronics retailer Suning has resumed selling iPads online this week in China after it stopped sales last week due to a supply shortage, rather than because of the lawsuit, company executives said.

China is becoming an increasingly pivotal market for Apple, which sold more than 15 million iPads worldwide in the last quarter alone and is trying to expand its business in the world?s No. 2 economy to sustain its rip-roaring pace of growth.

It now has a 76 percent market share in China?s tablet PC sector, followed by Lenovo Group Ltd and Samsung Electronics Co Ltd that have a combined share of only 10 percent, data from research firm IDC showed.

The country is also where the majority of its iPhones and iPads are now assembled, in partnership with Taiwan?s Foxconn.

A Shanghai court this week threw out Proview?s request to halt iPad sales in the city. But the outcome of the broader dispute hinges on a higher court in Guangdong, which earlier ruled in Proview?s favor.

The next hearing in that case is set for February 29. Proview lawyers said there might not be a decision immediately and it could take weeks or months before there was an outcome.

?It is more appropriate for both parties to mediate. I think that is the best outcome,? David Chen, senior partner at Allbright Law Offices in Shanghai.

China?s trademark system is a minefield of murky rules and opportunistic ?trademark squatters? that even the world?s biggest companies and their highly-paid lawyers find hard to navigate.

Legal experts say the onus is on companies looking to do business in China to understand how China?s trademark law works, as it differs greatly from that of the United States.

Industry executives have said employing special-purpose entities to acquire trademarks is a frequent tactic in China.

In the Year of the Memoir, you have to juggle a lot of things: writing, combing through layers of history and thinking about your audience. So keep a few things in mind as you continue your memoir journey.?

  1. Muse and gather the threads of thought and memory that will weave into your memoir. Take notes and keep a notebook of your insights and mini-stories.
  2. Research your story in family Bibles, ancestry.com, and journals. Gather and label your findings for easy access later.
  3. Interview friends and family to patch memory holes. It doesn?t have to be ?dueling memories.? Just find out what they remember, and marvel at the way memory works.
  4. Write regularly?several times a week?500 words. Bit by bit, you build your manuscript.
  5. Build your audience and connections?known as ?platform? through social media and blogging. Just start small, and only do what feels right. Gradually you will build your audience.

  1. I discovered that writing 500 words at a sitting is doable. How many words do you write? Give yourself permission to freewrite a ?messy first draft.?

Call For Action: Home Insurance | FOX8.com ? Cleveland news ...

If your house burned down or was badly damaged in a storm, you might not get the insurance coverage for which you think you?ve paid.

Brenda Tenison wasn?t taking any chances when she and her family moved into their new Mentor home about a year ago.? She called John Bollman, from State Farm?s Bollman Insurance Agency, and asked for advice.

?You really have to research and know what you?re getting and spend the time doing it, because if not, you may get burned later on,? Tenison said.

Bollman told Call for Action Reporter Lorrie Taylor homeowners policies aren?t what they used to be. For instance, just because a consumer buys replacement coverage for the contents of their house, doesn?t mean they?ll get a check for the full amount after making a claim.

?A company might say, ?Well, you have to replace everything in six months or we?re going to pay you the depreciated cost,? ? Bollman said.

The Mentor insurance agent said asking if there are any limits or restrictions on how coverage will apply at the time of a claim should prevent a consumer from getting a nasty surprise later.

?On homeowners policies, they do read differently now, and so, yes, you have to have some expertise in knowing what you get,? he told Taylor.

Most policies include a clause for ?Loss Of Use,? which is the insurance industry?s term for when a client has been forced out of their home.

?Let?s say it was destroyed by a wind storm or fire, and you?re going to be in a hotel for a while, most companies in northeast Ohio would write for two years coverage because sometimes you?re not even back in your house in one year,? Bollman said.

He said that?s not the case anymore.? He said some companies have cut their coverage back to a year, which means the customer would be forced to pay for lodging on top of the mortgage payment they?re already paying.? And that?s not the only nasty surprise that can turn up in the fine print.

?There are other things, like, is there a restriction on how many tools you can claim, are there restrictions on cameras, are there restrictions on firearms, that type of thing,? he said.

Bollman recommended homeowners read their policies to ensure they?re getting what they think they?ve paid for; advice that could save people like Tenison a fortune when they can least afford to lose it.

Eating Organic on a Budget | Toddler Times

organic 300x225 Making Room in Your Budget for Eating Organic In a perfect world, we would probably all feed our babies and toddlers all organic and healthy foods to give them the absolute best start in life we possible can. They?d eat organic fruits and vegetables as snacks, drink organic milk, and eat meat and eggs from pastured, organic sources. And of course, they?d eat it happily without a hint of complaining or pickiness.

Right! Wouldn?t that be nice?

Unfortunately, we don?t live in a perfect world, whether it?s picky toddlers, or a limited food budget, sometimes the ideal of healthy eating can seem so far out of reach.

For our family, I know the biggest reason that we aren?t able to eat all organically, all the time, is the cost. It?s no secret the organic food is a little pricier than conventional.

But, I still think that eating organic is really important, especially for for young children, and so we?ve made some changes, and found ways to save money in other areas of our life so that we can have the room we need in our grocery budget to purchase organic food for our family.

We have made a lot of changes in our family?s lifestyle toward more green and natural living over the past four years, and most of those changes have ended up saving us lots of money, maybe not at first, but definitely in the long run, and have made room in our limited budget to be able to buy organic food.

Here are just a few simple examples.

1. Cloth Diapering

We cloth diapered both of our kiddos which has saved us thousands of dollars. Even if you can?t commit to cloth diapering full time (we didn?t), you can still reap the benefits of saving money by using reusable diapers.

2. Making Homemade Cleaning Products

By making our own homemade and non-toxic cleaning products from inexpensive ingredients like vinegar and baking soda, we save ourselves the cost of both conventional brand cleaners, and the more expensive green and non-toxic brand cleaners. And guess what ? our homemade cleaners work just as well, if not better, than their conventional counterparts too!

3. Simplified Personal Care Products

We have switched to using safe and non-toxic personal care products, which can be more expensive, but we have greatly simplified the products we actually use (especially me!), from having bathroom cabinets filled with the next best beauty product or makeup item that didn?t quite work out and just ended up wasting money, to just having a few basic, necessary items. I also make some of our personal care products at home for a fraction of the cost of buying either conventional or green products.

4. Decreasing Disposables

By reusing items all around our house, we have eliminated the need to buy one-use items like paper towels and napkins, disposable cleaning cloths, and more. We like to live by the motto: Use it up, Wear it Out, Make Do, or Do Without ? and that really helps us to evaluate the cost of something before bringing it into our home, and to try to find something that we already have that will work for us.

5. Cooking from Scratch

Buying pre-made food items is expensive. And buying organic versions of pre-made food is even more expensive. Cooking at home, from scratch, using organic ingredients is one of the best ways to save money while still feeding your family healthy and organic food!

Riots spread as Greek lawmakers OK debt bill

The Greek parliament approved on Monday a deeply unpopular austerity bill to secure a second bailout from the European Union and International Monetary Fund and avoid a messy default.

The vote occurred after 100,000 demonstrators marched to the parliament and buildings were burned down in central Athens. Following the vote, black-masked protesters created a wall of fire with petrol bombs and set fire to cinemas, cafes, shops and banks.

Fifty police officers and at least 55 protesters were hospitalized. Forty-five suspected rioters were arrested; a further 40 were detained.

Following the vote to cut $4.35 billion ? which means axing one in five civil service jobs and slashing the minimum wage by more than a fifth ? violence spread to other Greek towns and cities, including on the holiday islands of Corfu and Crete.

"I've had it! I can't take it any more. There's no point in living in this country any more," said a man walking through his smashed and looted optician store.

Since May 2010, Greece has survived on a ?110 billion ($145 billion) bailout from its European partners and the International Monetary Fund. When that proved insufficient, a new rescue loan package worth a further ?130 billion ($171 billion) was decided ? combined with a massive bond swap deal that will write off half the country's privately held debt.

For both deals to materialize, Greece must persuade its deeply skeptical creditors that it has the will and ability to implement spending cuts and public sector reforms that will end years of fiscal profligacy and tame gaping budget deficits.

Before the vote on Sunday, Greek Prime Minister Lucas Papademos urged lawmakers to back the bailout reforms, saying the "wrong decision" in the bailout vote would lead to catastrophic default and exit from the euro.

Lawmakers voted 199-74 in favor of the drastic cutbacks. Following the vote, the two Greek parties supporting the government of technocrat Prime Minister Lucas Papademos expelled 43 deputies for failing to back the austerity bill.?

The conservative New Democracy party said it had expelled 21 of its 83 deputies. The Socialist PASOK party expelled about 20 of its 153 lawmakers.

"There are very few such moments in the history of a nation," Finance Minister Evangelos Venizelos said. "Our country has an acute issue of survival."

"The question is not whether some salaries and pensions will be curtailed, but whether we will be able to pay even these reduced wages and pensions," he added. "When you have to choose between bad and worse, you will pick what is bad to avoid what is worse."

The new cutbacks, which follow two years of harsh income losses and tax hikes ? amid a deep recession and record high unemployment ? have been demanded by Greece's bailout creditors in return for a new batch of vital rescue loans.

"By Wednesday, finance ministers from eurozone countries must finally approve the financing and support program for Greece," Venizelos said. "If that does not happen, and it is not at all certain that it will happen unless we raise to the occasion, then we will not be able by Friday, Feb. 17, to officially start the bond exchange process."

"We won't be in time to carry out the bond swap by March 5, and we won't be in time to address the problem of major bond issues that must be paid from March 14-20," he said. "If that doesn't happen, the country will go bankrupt."

Pressure from Europe
German Finance Minister Wolfgang Schaeuble was quoted as telling the Welt am Sonntag newspaper Sunday that Greece "cannot be a bottomless pit."

"That's why the Greeks must finally put a bottom in," he added. "Then we can put something in too."

Highlighting previous promises he said weren't kept, Schaeuble said "that is why Greece's promises aren't enough for us any more," according to the report.

Asked whether Greece has a long-term future in the eurozone, Germany's vice chancellor told ARD television "that is now in the hands of the Greeks alone."

Philipp Roesler said in the interview broadcast that what matters is not just Greece making pledges.

"We want ... the Greek parliament also to approve laws and, as far as possible, take the first steps to implement what has been agreed," he said.

"Only when that happens, only then can there be new aid ? and Greece urgently needs that," said Roesler, who is also Germany's economy minister.

Roesler acknowledged that Greece faces "difficult decisions" but stressed that Germany wants it to be able to get out of trouble.

"It is not enough just to give financial aid ? they must tackle the second cause of the crisis, the lack of economic competitiveness," he said. "For that, they need ... massive structural reforms. Otherwise Greece will not get out of the crisis."

Introducing the legislation Sunday, Socialist lawmaker Sofia Yiannaka said the intense pressure from Greece's EU partners to pass the measures was the result of delays in implementing already agreed reforms.

"The delays have our imprint. We should not blame foreigners for them," she said.

"We have finally found out that you have to pay back what you have borrowed ... We used to say 'poor state, but rich citizens' because we tolerated tax evasion for populist reasons. Is this the country we want?" Yiannaka added.

Leftist parties and the small rightist LAOS ? a former junior coalition partner ? opposed the the new austerity bill.

"You are not trying to save Greece, but a handful of industrialists," Communist Party spokesman Thanassis Pafilis said. "And you disgracefully blame the struggling people who created the wealth we have. You are trying to send them back to the Middle Ages. We will not allow it."

Under fire, Obama adjusts his birth control policy (AP)

WASHINGTON ? Under fierce election-year fire, President Barack Obama on Friday abruptly abandoned his stand that religious organizations must pay for birth control for workers, scrambling to end a furor raging from the Catholic Church to Congress to his re-election foes. He demanded that insurance companies step in to provide the coverage instead.

Obama's compromise means ultimately that women would still get birth control without having to pay for it, no matter where they work. The president insisted he had stuck by that driving principle even in switching his approach, and the White House vehemently rejected any characterization that Obama had retreated under pressure.

Yet there was no doubt that Obama had found himself in an untenable position. He needed to walk back fast and find another route to his goal.

The controversy over contraception and religious liberty was overshadowing his agenda, threatening to alienate key voters and giving ammunition to the Republicans running for his job. It was a mess that knocked the White House off its message and vision for a second term.

Leaders from opposite sides of the divisive debate said they supported the outcome ? or at least suggested they probably could live with it. Cardinal-designate Timothy Dolan of New York, the head of the nation's Roman Catholic bishops and a fierce critic of the original rule covering hospitals and other employers, said the bishops were reserving judgment but that Obama's move was a good first step.

The bishops' organization later issued a far more skeptical critique contending that the new approach offered insufficient protections for religious employers and calling that unacceptable.

Republicans hoping to oust Obama from the White House were conceding nothing. Though not mentioning the birth control issue, Newt Gingrich assailed the president's views of religious rights and said "I frankly don't care what deal he tries to cut. ... If he wins re-election, he will wage war on the Catholic Church the morning after he's re-elected."

Mitt Romney, the front-runner in the campaign for the GOP presidential nomination, said the decision didn't change anything.

"Today he did the classic Obama retreat, all right, and what I mean by that is it wasn't a retreat at all. It's another deception," Romney said while campaigning in Portland, Maine.

Obama, acknowledging he wanted a resolution to the controversy, ordered advisers to find a middle ground in days, not within a year as had been the plan before the uproar. He said he spoke as a Christian who cherishes religious freedom and as a president unwilling to give up on free contraceptive care.

"I've been confident from the start that we could work out a sensible approach here, just as I promised," Obama said. "I understand some folks in Washington may want to treat this as another political wedge issue, but it shouldn't be. I certainly never saw it that way."

Under the new plan, religious employers such as charities, universities and hospitals will not have to offer contraception and will not have to refer their employees to places that provide it. If an employer opts out of the requirement, its insurance company must provide birth control for free in a separate arrangement with workers who want it.

"Very pleased," was how Sister Carol Keehan, president of the Catholic Health Association, reacted in a statement distributed by the White House. Her trade group represents Catholic hospitals that had fought against the birth control requirement, and Keehan said the new arrangement addresses the concerns it had.

In searching for a way out of the crisis, Obama also had to be mindful not to anger many women and fellow Democrats.

Planned Parenthood, a prominent women's health organization, said Obama had reaffirmed his commitment to birth control coverage. The group's president, Cecile Richards, added, though, that it would be monitoring for "rigorous, fair and consistent" enforcement so women get the promised coverage.

Before announcing his decision to reporters, Obama telephoned Keehan, Richards and Dolan.

At the Conservative Political Action Conference in Washington, where Gingrich made his comments, many said the White House rewrite did not change anything.

"It's an accounting trick," said Mike Gonzales of the Heritage Foundation. "Do they think people are stupid?"

The debate within the White House was intense even before the Jan. 20 decision was announced to exempt only churches and other houses of worships from the requirement that employers must cover free contraception. Other religious organizations were given an extra year to comply, but that concession didn't do enough.

First in a rumble, and then in a roar, critics formed a movement to overturn what they considered to be an egregious violation. Bishops assailed the policy in Sunday Masses and Republican leaders in Congress pledged to push a legislative repeal.

The White House seemed to be caught flatfooted.

"The past three weeks have witnessed a remarkable unity of Americans from all religions, or none at all, worried about the erosion of religious freedom and government intrusion into issues of faith and morals," said Dolan, the president of the United States Conference of Catholic Bishops.

The turmoil, in turn, prompted advocates from other sides to get vocal in the battle for public opinion. They defended the rights of women and the need for preventive health care, including contraception, to be provided without fee for people of all faiths, no matter where they work.

Officials said Obama has the power under his health law to compel insurance companies to provide free contraception coverage directly to workers.

The health insurance industry voiced concern that putting the burden on them could set a precedent of shifting cost its way. The insurance companies will weigh in later as Obama's new policy undergoes review, said Robert Zirkelbach, spokesman for the America's Health Insurance Plans trade group.

Administration officials say providing birth control won't cost insurers any more in the long run, because it's less expensive than the costs of maternal care and delivery. But insurers say they'll have to pay drug companies for pills and doctors for prescriptions, so it won't be free to them. The costs probably will be passed on to policyholders, as is happening already with other requirements of the health care law, such as allowing young adults to stay under their parents' coverage until age 26.

By keeping free contraception for employers at religious workplaces ? but providing a different way to do it ? Obama was able to assert he had found "a solution that works for everyone." Unclear was why the White House had not come up with the idea in the first place.

While Obama in 2008 won the total Catholic vote, 54 percent to Sen. John McCain's 45 percent, he lost the white Catholic vote, 52 percent to 47 percent, according to exit polls. Once reliably Democratic, Catholics are now swing voters, with white Catholics making up the majority of the group.

The Rev. Joel C. Hunter, a moderate evangelical leader and a spiritual adviser to the president, said he thinks Obama responded quickly enough to heal the rifts with many of his religious allies. "I think it's simple enough that most people will say, `Oh good, we can get to other things now,'" said Hunter.

Yet the change just led to more criticism from some of Obama's opponents.

A spokesman for House Speaker John Boehner said that that initial response indicated church leaders were not yet convinced the mandate respected religious freedom. Boehner has said he believes the original measure violates First Amendment rights, and his office said Friday that he would seek legislation.

House Minority Leader Nancy Pelosi, D-Calif., an ardent support of the original measure, offered a restrained response. Focusing on the benefits of health care, she said: "I appreciate the president's unifying approach."

Turbo-traders take Bank of America for a ride (AP)

NEW YORK ? On a normal day, 4 billion shares of stock change hands on the New York Stock Exchange. One in 10 belongs to a single company. It's not McDonald's or IBM, both of which have been on a tear.

It's Bank of America ? bailed out by the government three years ago, reviled for being part of the mortgage frenzy that helped wreck the economy and selling for not much more than an ATM fee.

When the market goes up because of positive news about the economy, Bank of America stock shoots up past the stocks of other big banks. When traders get worried about Greek debt, Bank of America takes the biggest plunge.

The big swings are not driven by a fundamental bet that the bank will be more profitable because the economy is getting better or a real concern that it will lose more money than others if there is a default in Greece.

Instead, Bank of America is the stock of the moment for high-frequency trading, the supercomputer-driven buying and selling that barely existed a few years ago and now accounts for as much as two-thirds of U.S. trading.

The bank's single-digit stock price and flood of shares on the market ? three times as many as its nearest big-bank competitor ? make it an attractive target for hedge funds and banks that employ high-powered, computerized trading.

"The movement of Bank of America stock on most days has nothing to do with Bank of America," says Joseph Saluzzi, co-founder of brokerage firm Themis Trading.

In other words, the stock moves because it moves. Bank of America stock has risen or fallen 1 percent or more on 20 days this year. The Standard & Poor's 500 index has only done it three times.

For the year, Bank of America is up 46 percent, best of the 30 stocks that make up the Dow Jones industrial average. Big banks collectively are up 15 percent.

In high-frequency trading, investors use computer algorithms to exploit small changes in a stock's price. If a computer can seize on a stock like Bank of America a fraction of a second faster than the rest of the market, it can book a tiny profit.

Those pennies add up over tens of millions of shares a day to produce big gains. And when computers rush to buy or sell a stock like Bank of America, it can result in accelerated moves in the stock price. Buying leads to more buying, selling to more selling.

Bank of America is part of the Standard & Poor's 500, and therefore held in mutual funds in the retirement accounts of millions of Americans. And mutual fund managers hate high-frequency trading.

Not only does it make the stocks in their portfolios more volatile, but fund managers fume that high-frequency computers can detect their stock orders, step in to change the price of a stock slightly and pocket a small profit.

"It has nothing to do with the fundamentals," says Leon Cooperman, a billionaire investor, chairman of hedge fund Omega Advisors and former CEO of Goldman Sachs Asset Management.

For computers to move in and out quickly, there must be enough shares available to trade. Bank of America has a truckload ? 10.5 billion shares outstanding, compared with 3.8 billion for JPMorgan Chase and 2.9 billion for Citigroup.

The stock traded as high as $15.31 last year. Then investors, worried about how deep the bank's mortgage problems might be, drove it below $10 in July. High-frequency traders pounced, and Bank of America's volume exploded. It was 147 million shares last summer. On Thursday, 477 million shares changed hands.

The low price put it in the sweet spot for high-frequency trading. If a high-frequency operation is trading blocks of 100 shares at a time to capitalize on a 1-cent change, there's a lot less risk working with a $5 stock than a $500 one.

It makes Bank of America "a juicy trade at very little risk," says Adam Sussman, director of research at Tabb Group, a markets advisory firm.

In 2009 and 2010, Citigroup, then part-owned by the government, was in the same spot. Its price was in single digits, and it seesawed day to day. It was often the highest-volume stock ? as many as 500 million shares changing hands in one day.

Last year, Citi reduced the number of shares by exchanging one share for every 10. That brought its stock price up ? $33 on Wednesday ? and high-frequency traders stopped flocking to it. Volume on a normal day has dropped to 50 million.

Bank of America went the opposite way in November and December and sold 400 million more shares to the market to raise $3.5 billion and improve its financial stability.

Today, some investors ? the human ones ? are buying Bank of America because they like CEO Brian Moynihan's efforts to shore up the company's finances. Other investors won't touch it because they are afraid of the billions Bank of America is still spending to fight mortgage lawsuits. Charles Bobrinskoy, director of research at Ariel Investments, even calls the company "unanalyzable."

But none of those groups is driving the stock. Some days, it moves with little or no tangible reason.

On Jan. 5, the stock jumped 8 percent with no explanation. The Wall Street Journal blogged that the stock was rising on "reports/rumors/blind hopes" about President Barack Obama appointing a new head to the federal housing agency.

On Jan. 10, a Barclays bank analyst lowered his price target on Bank of America stock and Morgan Stanley and Zacks Investment Research downgraded the stock. The stock didn't fall ? it popped up 6 percent more.

Analysts say high-frequency trading is partly responsible for the huge daily swings in the market in 2010 and 2011. The technique gained notoriety after May 6, 2010, the day of Wall Street's "flash crash." The Dow fell almost 1,000 points in minutes, bewildering traders and inciting panic. The market recovered to close down 348 points.

High-frequency trading was blamed and attracted scrutiny from regulators. The Securities and Exchange Commission didn't ultimately blame high-frequency trading for the crash, but said it exacerbated the decline. Regulators haven't done anything to curb it.

Sometimes high-frequency traders don't even profit from the trade itself. They buy and sell shares at the same price and make money by sending large orders through the exchanges.

NYSE, Nasdaq and others want to attract the most traders. So they offer rebates of 20 to 32 cents per 100 shares to traders who send in large orders. On the electronic exchange NYSE Arca, traders who can move 35 million shares pocket a quick $112,000.

"Rebates will be the same no matter what the price, so the computers keep trading all day long," says Keith Bliss, senior vice president at brokerage firm Cuttone & Co.

Bank of America says it has no position on high-frequency trading. At some point it could reduce its shares, as Citi did. But the bank is focused on strengthening its finances, the reason it sold more shares in November and December.

Bank of America's chief financial officer, Bruce Thompson, told reporters in January that the bank isn't likely to buy back stock this year. So for now, those human investors will have to buckle up for the ride.

Painter William Theophilus Brown dies at age 92 (AP)

SAN FRANCISCO ? William Theophilus Brown, a painter who enjoyed success for more than half-a-century and was closely associated with the San Francisco Bay area's "figurative" movement, has died. He was 92.

Brown died Wednesday in his apartment at a San Francisco high-rise retirement community, gallery owner Thomas Reynolds told the San Francisco Chronicle (http://bit.ly/zRdvAj). He said Brown painted and took art classes until the end of his life.

Brown's partner of nearly 50 years, the celebrated artist Paul Wonner, died in 2008.

Brown was part of the figurative movement that art historians recognize as a period during the mid-20th century when artists moved away from extreme abstractionism and included some realism in their portraits, landscapes and still-lifes. The Metropolitan Museum of Art in New York, the Hirshhorn Museum in Washington, D.C., and the M.H. de Young Memorial Museum in San Francisco are among the institutions that exhibit his paintings.

He was born in Illinois and trained at Yale University and the University of California, Berkeley.

Brown had his first solo exhibition at the Felix Landau Gallery in 1957. A year earlier, he had attracted national attention when Life magazine published three of his paintings featuring football players in motion.

Brown, who professionally went by the name Theophilus, told the Chronicle in October that he moved to the Bay area during the 1950s in part because he needed to separate himself from artistic luminaries such as Pablo Picasso, Alberto Giacometti, and Willem de Kooning, with whom he socialized after World War II.

"I moved here because I was orbiting around all of these famous people, and I needed to find out who I was," he said.

He befriended younger artists and poked fun at himself. Attorney Matt Gonzalez, a former city supervisor who had a ritual of spending weekends with Brown, working in the artist's studio and then going out to eat oysters and drink fine whiskey, said he last saw his friend on Saturday.

"I took him 36 oysters Saturday night and we shared dinner," Gonzalez said. "He had a good appetite and was in good spirits. But he couldn't leave the apartment, and he was clear that if he couldn't go to his studio and make art anymore, he didn't want to live. So it was time."

A private memorial was being planned.
